The London Central Employment Tribunal has upheld a claim of whistleblowing detriment and a claim of unfair dismissal brought by a former Senior Parliamentary Advisor, Ms Elaina Cohen, against her former employer, Khalid Mahmood MP.

The Claimant was the successful in respect of the following claims:

  • The claim of unfair dismissal pursuant to section 94 & 98 of the Employment Rights Act 1996
  • The claim of detriment because of a protected disclosure pursuant to section 47B of the Employment Rights Act 1996 in respect of the allegation that she was marginalised and isolated in the period January 2020 until her dismissal.

The remaining claims were dismissed.
