Marcus Dignum QC & Hugh Hamill have been instructed by Olly Bowes-Smith and Steven King of DWF to represent Aviva PLC  in a 9-day trial commencing at the High Court on Monday 7th February.

The Claimant, a highly successful artist is seeking damages in excess of £30m following a brain injury which it is alleged has resulted in him producing 14 fewer paintings per year than he otherwise would.

The Court is also being asked to determine whether there is any link between traumatic brain injury and the onset of later dementia, and if so,  given the alleged increased risk,  whether this would be an appropriate case to make an award of provisional damages.

The case has been covered by the Standard which you can see here.
