Congratulations to Jessica Franklin, junior counsel for the claimants, who successfully resisted British Airways’ appeal in the case of British Airways PLC v Rollett & Others.

British Airways appealed the Employment Tribunal’s finding that it had jurisdiction to hear associative indirect discrimination claims under s19 Equality Act.

In a judgment handed down this morning, the Employment Appeal Tribunal dismissed the appeal. It found that s19 Equality Act can support claims where (a) there is a PCP that puts people with a particular protected characteristic at a disadvantage, and (b) where a claimant also suffers that disadvantage, but does not have the same protected characteristic as the disadvantaged group.
