As experienced and award winning personal injury barristers, we have broad expertise in product liability litigation, ranging from claims with a contractual or tortious basis, to regulatory proceedings and prosecutions.

12KBW has acted in some of the most exciting and novel product liability cases of the past few decades, for both claimants and defendants. We have undertaken industrial disease claims, and claims involving pharmaceutical products, breast implants, consumer goods, mobility equipment and food and drink. We are consistently instructed to appear in the most difficult liability, and the largest quantum, trials, and we cover cases at every level from District Judge to the Supreme Court.  We also advise clients on precautionary steps and on compliance with legislation, in particular the Consumer Protection Act 1987 and the Consumer Rights Act 2015.

We bring expertise in international litigation to product liability claims.  Product liability claims are increasingly cross-border in nature, in the increasingly interconnected global economy. Manufacturers assemble products with components produced in multiple jurisdictions making the international basis of such claims especially complex. Our barristers are acutely aware that international product liability is a growing area of legal practice, and we have the extensive cross-border expertise necessary to act for both defendants and claimants in this field.

We are, at present, instructed by a large number of pilots, air-crew and their families to pursue claims that ingestion of cabin air contaminated with organophosphate and other chemicals have caused long-term injury and have even contributed to death.  Whilst this litigation is in its early stages, it already involves complex jurisdictional issues given the international nature of both the exposure and the aircraft design which is alleged to permit it.
