We advise and represent clients in policy construction and coverage disputes, on subrogation issues, and in disputes related to non-disclosure, misrepresentation and breach of warranty. We are known for our ability to provide commercial solutions, our industry knowledge and our outstanding advice and advocacy.

Our barristers are regularly instructed across policy coverage areas, including employer’s and public liability, professional indemnity, and motor and property damage policies. The breadth and depth of our experience in our other specialist areas allows us to offer a complete service for related liability and insurance disputes.

Many of our barristers are leading practitioners in motor insurance litigation. We have expert knowledge of the statutory framework underlying this area as well as the leading case law and the industry at large. Several 12KBW silks have been appointed as arbitrators under the Motor Insurers’ Bureau’s Untraced Drivers’ Agreements. We are regularly instructed in claims involving the MIB.

We are particularly well placed for insurance disputes with an international element: we advise motor insurers in cross-border road traffic accidents, including domestic proceedings brought against foreign insurers and proceedings brought directly against English insurers or the MIB in respect of accidents abroad.
